Right of Access to Information

The right to access and reuse information is regulated and exercised in accordance with the Act on the Right of Access to Information (Official Gazette, Nos. 25/13, 85/15; hereinafter: the Act).

Under the Act, any domestic or foreign natural or legal person (hereinafter: the user) has the right to request and receive information. The Split City Museum (hereinafter: the Museum) is required to provide access to requested information and to publish information proactively when mandated by law or other regulations, regardless of whether a request has been submitted.

Information refers to any data held by the Museum in the form of documents, records, files, or registers, regardless of format (written, drawn, printed, recorded, magnetic, optical, electronic, or otherwise) which the Museum has produced itself, in cooperation with other entities, or received from a third party, and which has been created in the course of, or in connection with, the Museum’s organisation and operations.

The Museum is a public institution engaged in museum activities.

As part of its work, the Museum:

  • Collects, preserves, studies, researches, processes, and organises cultural assets from the city of Split’s heritage
  • Safeguards museum collections and documentation
  • Prepares and stages permanent and temporary exhibitions
  • Publishes information and research findings on museum collections and documentation through professional, academic, and other informative channels
  • Keeps the public informed about its activities by publishing information in a timely, appropriate, and accessible manner, including on the Museum’s website.

In addition to the methods outlined above, users may exercise their right to access information by making an oral or written request to the Museum or to the designated information officer.

Requests to access and reuse information can be submitted to the information officer through any of the following means:

  • in person at: Muzej grada Splita Papalićeva 1, 21000 Split, Monday to Friday, 8:00 – 16:00.

If a request is made orally or by telephone, an official record will be made. Requests submitted electronically will be considered written requests.

The Museum may require the user to cover any actual costs incurred in providing the information, as well as the cost of delivering it. At the user’s request, the Museum must provide a breakdown of the fee calculation, in accordance with the Act on the Right of Access to Information. The Museum may also deny access to information in circumstances specified by the Act.

The Museum will respond to a request for access to information within 15 days of receiving a complete and properly submitted request. If a request is incomplete or unclear, the Museum will promptly ask the applicant to correct it within five days of receiving the notice. Should the applicant fail to provide an appropriate correction, and it remains unclear what information is being requested, the Museum will reject the request by formal decision.

If the Museum does not hold the requested information but knows which body does, it must forward the request to that body without delay, and no later than eight days after receiving it, while notifying the applicant accordingly. Time limits for exercising the right of access to information are calculated from the date the competent public authority receives the forwarded request.

The deadline for exercising the right of access to information may be extended by 15 days from the date the Museum was due to decide on the request, in the following circumstances:

  1. if the information must be obtained from outside the Museum’s premises,
  2. if a single request involves a large number of different pieces of information,
  3. If an extension is required to ensure the completeness and accuracy of the requested information,
  4. if it is necessary to carry out an assessment of proportionality and public interest, in accordance with the Act on the Right of Access to Information.

The Museum will notify the applicant of any extension without delay, and no later than eight days from the receipt of a properly submitted request, providing the reasons for the extension.
